1. Acceptance of Terms

By accessing or using ChurchServant ("Service"), operated by ChurchServant ("we," "us," or "our"), you agree to be bound by these Terms of Use. If you are registering on behalf of a congregation or organization, you represent that you have authority to bind that organization to these terms.

2. Description of Service

ChurchServant is an all-in-one church management platform built exclusively for Churches of Christ. The Service may include, but is not limited to:

  • Bulletin and slide deck generation
  • Worship service roster management
  • Member and family directory
  • Communications (SMS, email, voice calls, and push notifications)
  • Congregation website hosting
  • Event management and calendar
  • Prayer list tracking
  • Attendance tracking
  • Treasury and financial management tools
  • Sermon management and video shorts
  • Social media scheduling
  • AI-assisted content generation
  • Digital foyer display board

3. Accounts and Registration

To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Each congregation account may have multiple users with role-based access (Administrator, Leader, or Member). The account administrator is responsible for managing user access and permissions within their congregation.

You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

4. Pricing and Payment

The Service is offered at a base fee of $10 per month plus $1.50 per member per month. The first 10 members are included at no additional cost. Congregations with up to 100 members may use the Service free of charge during the introductory period.

We reserve the right to modify pricing with at least 30 days' advance notice to your account email. Continued use of the Service after a price change constitutes acceptance of the new pricing.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Upload or transmit malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to other accounts or systems
  • Use the communications features (SMS, voice, email) to send spam or unsolicited messages to individuals who have not consented to receive them
  • Misuse the AI features to generate harmful, misleading, or inappropriate content
  • Interfere with or disrupt the Service or servers
  • Resell or redistribute the Service without our written consent
  • Scrape, collect, or harvest data from the Service by automated means

6. Your Content and Data

You retain ownership of all content and data you upload to the Service, including member information, photos, documents, communications, and financial records. We do not claim ownership of your content.

By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing and improving the Service. This includes processing content through third-party services as described in our Privacy Policy.

You are responsible for ensuring that you have the right to upload and use all content submitted to the Service, and that such content does not infringe on the rights of any third party.

7. Communications Features

The Service includes the ability to send SMS text messages, voice calls, emails, and push notifications to your congregation members. By using these features, you agree to:

  • Only send communications to individuals who have consented to receive them
  • Comply with all applicable laws including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act
  • Honor opt-out requests promptly
  • Use voice and SMS features only for legitimate congregation communications

We are not responsible for the content of messages you send through the Service. Standard messaging rates may apply to recipients.

8. Financial Tools

The Service includes treasury and financial management tools that may connect to your bank accounts through Stripe Financial Connections. These connections provide read-only access to account and transaction data for budgeting and reporting purposes.

ChurchServant is not a financial advisor, accounting firm, or bank. The financial tools are provided for organizational convenience and should not replace professional financial or accounting advice. You are responsible for the accuracy of your financial records and compliance with applicable tax and financial regulations.

9. AI-Powered Features

The Service uses artificial intelligence to assist with content generation, sermon analysis, transcription, and other features. AI-generated content is provided as a starting point and should be reviewed for accuracy before use. We do not guarantee the accuracy, completeness, or appropriateness of any AI-generated content.

Content submitted for AI processing may be sent to third-party AI providers (such as OpenAI, Anthropic, and Google) for processing. Please review our Privacy Policy for details on how these services handle your data.

10. Congregation Website Hosting

The Service includes website hosting for your congregation, available via a ChurchServant subdomain or your own custom domain. You are responsible for all content published on your congregation's website and must ensure it does not violate any applicable laws or third-party rights.

We reserve the right to suspend or remove websites that violate these terms or contain illegal or harmful content.

11. Intellectual Property

The Service, including its design, code, features, and documentation, is owned by ChurchServant and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

12. Termination

You may cancel your account at any time. Upon cancellation, your access to the Service will end at the conclusion of your current billing period.

We may suspend or terminate your account if you violate these terms, fail to pay applicable fees, or if we reasonably believe your use of the Service poses a risk to us or other users. We will make reasonable efforts to notify you before termination except in cases of serious violation.

Upon termination, we will retain your data for a reasonable period to allow you to export it. After that period, your data may be permanently deleted.

13. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. We are not responsible for any loss of data, revenue, or other damages arising from your use of the Service.

14. Limitation of Liability

To the maximum extent permitted by law, ChurchServant shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claim arising from these terms or your use of the Service shall not exceed the total amount you paid to us during the twelve (12) months preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless ChurchServant, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these terms, or your violation of any rights of a third party.

16. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes arising from these terms or the Service shall be resolved in the courts of competent jurisdiction.

17. Changes to These Terms

We may update these Terms of Use from time to time. When we make material changes, we will notify you by email or through a notice on the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the revised terms.
